Notes to the Installing Contractor and End-User regarding the installation:
|
- Scheduling: 72-hour advance notice is required for the scheduling of an installation. The Installing Contractor will be provided with the name and phone number of the freight company, along with the shipment “Pro Number,” so that the delivery may be traced to its’ final destination location. It is the responsibility of the Installer to contact the freight carrier to arrange for the delivery time and date of the shipment. Neither RA nor the Shipper are responsible for charges that may occur as a result of lost time awaiting freight deliveries that have been scheduled between the installer and the freight company. If you are notified from RA that a shipment is arriving via a “Dedicated Carrier” the installer is expected to be at the job site to accept delivery at the appointed time (usually 8 a.m.) unless otherwise notified.
- Lost Time: If the Installing Contractor is asked to report to the job site on a specific day and time and, upon arrival, the job is not ready for installation, additional charges may be incurred. Refrigeration Alliance must be notified immediately if an installation and/or delivery can not take place as scheduled. If imposed, maximum additional charges will not exceed one full-day’s wages for two (2) men including travel time. Minimum additional charges will not exceed two hours wages for (2) men each, including travel time.
- Additions, Deletions, Exclusions: : Any additions, deletions and/or exclusions to the standard installation policy must be noted in writing and clearly marked on the job quotation, specifications and Purchase Orders issued.
- Legal Fees Incurred: Should a dispute arise regarding any area of the performance of the installation contract which requires or results in subsequent litigation, all legal fees incurred will be the sole responsibility of the “losing” party against which the resultant judgment is found.
- Jurisdiction: This Agreement and subsequent contract is negotiated and empowered in the State of California and the County of San Diego, and as such is subject to all relevant laws and regulations.
- Dress: All installers are to be dressed appropriately for safety considerations, with hard hat, work shoes, and eye/ear protection if necessary. All precautions must be taken when working with hazardous chemicals or machinery. Easily identifiable work shirts (with sleeves) and long pants should be worn by the installing crew.
- Union Labor/Prevailing Wages: All standard installation prices/quotations from Refrigeration Alliance are based upon Non-Union Labor and Non-Prevailing Wage Rates, and all work is to occur during a standard 40-hour workweek. The End-User should submit a written request for a Union Installation, and a supplemental quotation will be provided by Refrigeration Alliance. Any interference from Labor Union Agents or Officials during an installation may result in an increase in the original contracted price from Refrigeration Alliance, and additional costs incurred as a result of union involvement will be added to the original contracted price. Refrigeration Alliance will notify the end-user if any charges are likely to be incurred.
